Photography for purposes other than Real Estate marketing

Please note, in using the photography supplied to you on disc or electronically, you are agreeing to the following terms and conditions:

Usage of photography.

Usage is as per original written agreement. If not stated otherwise, usage is for one media type only and limited to 1 year use beginning from shoot date. Copyright is held by Reflex Digital, and is not transferable. Rights for conditional, non-exclusive usage are licensed only upon full payment of the invoice. If any images are used prior to full payment-you are in breach of copyright. Any request for publication/sub-licensing of photographs (via print or internet or any other medium) taken by Reflex Digital, which is outside the specified agreement , must be made in writing to Reflex Digital, for our consideration.No alteration or manipulation of the image may be made without the permission of Alex Nikulin. Any breaches in copyright will be pursued vigorously.If full payment of supplied invoice is not made within 30 days of receiving the invoice, you may be charged additional fees of 9% of the total invoice per month for every month the invoice has not been fully paid for filing and legal fees.You agree to pay your collection costs in the event of a payment default. The photographer shall not be liable for any legal action, claim or damages resulting from or arising out of the publication of the photographs or other use. Orders and accounts. When signing the account application you agree that on our acceptance of you application, you or employees of your company may place an order using paper,verbally or electronically including via sms, email or telephone. This order is considered to be an official order from your company and is subject to all the terms and conditions listed here. Legal obligations and expenses. You personally agree to pay for any legal and related expenses made by Reflex Digital or Alex Nikulin in the pursuit of any breaches of copyright that were made by yourself, your company or you and your company’s current or former employees. The photographer shall not be liable for any legal action, claim or damages resulting from or arising out of the publication of the photographs or other use.

Unless otherwise stated in writing by Reflex Digital , any photography supplied by Reflex Digital now or in the future is to be used for your real estate marketing purposes only. Copyright is held by Reflex Digital, and is not transferable. Photography is to be used for the original marketing campaign by the original real estate agency only. The current owner of the property (at the time the order is placed with Reflex Digital) may also use the photographs as a personal memento, but does not retain any copyright for commercial purposes. Rights for conditional, non-exclusive usage are licensed only upon full payment of the invoice. If any images are used prior to full payment-you are in breach of copyright. Any request for publication/sub-licensing of photographs (via print or internet or any other medium) taken by Reflex Digital, which is outside the specified original marketing campaign (including any use by architects, builders, painters, kitchen suppliers, stylists and any print or web publications), must be made in writing to Reflex Digital, for our consideration. No alteration or manipulation of the image may be made without the permission of Alex Nikulin. Some of the photographs may have been manipulated at the owners’ / agents’ request, so please check on the appropriate laws relating to the publication of these photographs. The party which has ordered these photographs agrees to assume all legal liabilities relating to the publication of these photographs. Watermarking

Terms and conditions are embedded in each photo. Please also be aware that some photos may have invisible watermarking embedded as well. This watermarking can withstand cropping,resizing and repurposing. It is impossible to detect the watermark without a key. Watermarking may be detected using web trawling automated spiders. You agree to all these terms and conditions and any alterations to these terms and conditions without necessarily being notified of these alterations. Please check this site from time to time to stay informed of what you are agreeing to. If at any stage you do not agree to these terms and conditions, you must notify Reflex Digital in writing.
